TERMS & CONDITIONS OF SERVICE

Legally Binding Contract. By placing an order or using any services of Schlabach Printers LLC (“Schlabach,” “We,” “Our,” or “Us”), you agree to be bound by this these Terms and Conditions of Service (these “Terms”), and you agree that you are eighteen years old or older and have capacity to create binding legal obligations.

Artwork. You are fully responsible for ensuring that all artwork, designs, images, files, or related contents and materials you upload or submit to Us (collectively, “Content”) are accurate, appropriate, and comply with applicable laws. You agree not to submit any Content containing offensive, indecent, or unlawful material, including, but not limited to, content that could result in civil or criminal liability, or material that promotes hate or violence. We reserve the right to refuse your submission of any Content for any reason, or for no reason. Any Content submitted is done at your own risk. We are not responsible for retaining, storing, or safeguarding your Content, and We assume no liability for the deletion, loss, corruption, or failure to store any Content submitted to Us, regardless of cause. Once your Content is uploaded to Our system, you acknowledge that it may be deleted at any time following the completion of your order or as part of Our routine data management practices.

Intellectual Property. You represent and warrant that you own all Content, and all parts thereof, submitted to Us or that you have obtained all necessary rights, licenses, and permissions to use such Content. You acknowledge and agree to assume all liability for any claims of intellectual property infringement related to Content you provide to Us. You agree to indemnify and hold Us harmless against any and all costs, liabilities, damages, reasonable attorneys’ fees, and expenses arising from claims related to intellectual property infringement.

Ownership and Use of Content. The Content, and any portion thereof, that We create for you, or for another customer, remains the property of you or the respective customer upon completion of the project. However, you are not permitted to reproduce any Content displayed on Our website without Our prior written consent. We retain the right to use these materials as samples or for advertising purposes, both online and offline, unless you provide Us with a written request explicitly stating otherwise.

Proofs. After submitting Content, a digital proof will be provided for your review. You are strongly encouraged to carefully examine the proof for any issues regarding layout, text, images, cropping, and bleeds. Production will not begin without your written approval or waiver of the proof. Please note that the digital proof does not represent an accurate color reproduction of the final printed product, as color discrepancies may occur due to the limitations of digital displays, RGB/Pantone to CMYK conversion, and the inherent nature of the printing process. We are not responsible for any color variation between the proof and the final print. By approving the proof, you assume full responsibility for all content in the final product.

Order Approval. You are fully responsible for final proof and layout approval prior to the printing process. Any jobs that have been approved and/or or sent to press cannot be altered or changed due to the nature of the printing process, and We are under no obligation to issue any refunds. We are not liable for errors in a final product, including, but not limited to, those caused by: misspelling; graphics; bleeds; grammar; damaged fonts; punctuation; wrong cuts, incorrect or missing folds; die lines; crop marks; transparency; overprint; cracks on folds; finished product size; and/or poor orientation or alignment.

Color Accuracy. While We take precautions to ensure the color accuracy of your printed order, We cannot guarantee an exact match between the colors in your submitted Content and the final printed product. Color reproduction may be affected by various factors, including the conversion from RGB to CMYK, ink densities, and printing processes.

Over-Runs and Under-Runs. .

. Over-runs or under-runs will not exceed ten percent (10%) of the ordered quantity. We will charge you based on the quantity delivered within this tolerance. If you require a guaranteed quantity, the acceptable tolerance percentage must be specified, in writing, at the time of the quote. Additional charges may apply.

Turnaround Time. Turnaround time refers to the period required for Us to print your order and hand it over to the shipping carrier. This does not include design time. Turnaround time begins the business day after We receive the following: your Content, approval or waiver of all proofs, and payment terms are met. Turnaround time excludes shipping and delivery times, which vary based on the shipping method chosen. Please note that weekends and holidays are not counted in the turnaround time. If your project is time-sensitive, you must specify the exact date or timeframe by which you need the order completed at the time of the order. Failure to do so may result in delays, and meeting your specified time may be subject to additional charges for expedited processing.

Shipping. You are responsible for selecting your preferred shipping method at checkout. Once your order is with the shipping carrier, We are not liable for any delays or issues caused by the carrier, weather conditions, or other unforeseen events. Shipping transit times are determined by the carrier and may not include weekends or holidays. We are also not responsible for damages that occur after your order has been handed over to the carrier. While you choose the shipping method, We reserve the right to ship your order via any carrier We deem appropriate, and We may modify the shipping method at Our discretion. We are not responsible for incorrect shipping addresses provided by you, and any reshipping due to address errors will incur an additional charge. Once the package is shipped, We do not offer refunds on shipping charges. Shipping transit times are estimates and are subject to delays beyond Our control. If your order is delayed or damaged in transit, We will not be held liable, but you may contact the carrier for claims.

Cancellations, Returns, and Refunds. All sales are final. However, an order may be canceled before production begins, subject to a processing fee of fifteen percent (15%) of the total order amount (with a minimum fee of $15). Orders pending for more than ninety (90) days may be automatically canceled with no refund if proof Content, proof approval, or shipping information are not provided. Since each order is customized based on your specifications, no refunds will be issued once We begin processing your order. Work typically begins upon receipt of your files and payment. If We have not started production or sent your order to press, a partial refund may be considered, minus any labor or administrative fees. Refund requests will not be accepted more than seven (7) days after the order date. In the event of a production or shipping error, you must notify Us within thirty (30) days of receiving the product. We will correct the issue at no additional cost, but We are not responsible for damage caused by your actions or the actions of any third parties. Returns will only be accepted with prior, written authorization, and shipping fees are non-refundable. If authorized, We will send a corrected or reprinted product once the returned items are received.

Payment. By placing an order, you agree to pay for all associated costs, including, but not limited to, product or service charges, taxes, shipping, handling, import/export fees, insurance, and postage. You authorize Us to charge these costs to the credit card you provide. If you are placing the order on behalf of a third party, you confirm that you have informed them of these Terms, and in the event they fail to pay, you are responsible for payment.

Miscellaneous. To the fullest extent permitted by law, Our liability to you for any claim related to your order or use of Our services shall be limited to the amount you paid Us for the specific products or services giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if We were advised of the possibility of such damages. Our total liability in any case will not exceed the amount you have paid for the specific order or service in question. You agree to indemnify, defend, and hold harmless Us, Our affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of Our products and services, including, but not limited to, any claims related to the Content, the production or delivery of your order, or any breach of these Terms. This includes claims brought by third parties alleging infringement of intellectual property rights or any violations of applicable laws.
